1. Acceptance of Terms

These Terms and Conditions ("Terms") govern access to and use of the Eduzo platform, website, applications, educational content, and related services (collectively, the "Platform") provided by Eduzo Games India Private Limited ("Eduzo", "we", "our", or "us").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you should not access or use the Platform.

2. Educational Purpose

Eduzo is an educational technology platform designed to provide gesture-based, motion-enabled, game-based learning experiences for schools, teachers, and students.

The Platform is intended solely for educational purposes and is not intended to replace professional teaching, educational assessment, or educational decision-making by qualified educators.

3. Eligibility

The Platform is intended for use by:

  • Schools and educational institutions
  • Teachers and school staff authorised by a school
  • Students under the supervision of a school
  • Parents or guardians where access is provided by a school

Students may only access Eduzo through accounts authorised by their school.

4. School Responsibilities

Schools are responsible for:

  • Maintaining accurate student and staff information
  • Obtaining any parental notices, permissions, or consents required by applicable law
  • Supervising student use of the Platform
  • Ensuring compliance with their own internal policies
  • Protecting account credentials assigned to school personnel

Schools remain responsible for educational decisions made using reports, analytics, or recommendations generated by the Platform.

5. Accounts and Access

Users must provide accurate information when creating accounts.

Account credentials must be kept confidential.

Schools are responsible for managing user access within their institution.

Eduzo may suspend access where misuse, security risks, or violations of these Terms are identified.

6. Student Data and Privacy

Use of the Platform is subject to Eduzo's Privacy Policy.

Schools acknowledge that they are responsible for obtaining any permissions or consents required for student participation.

Eduzo processes student data solely to provide educational services requested by the school.

7. School Ownership of Data

Student records, learning analytics, assessment results, reports, curriculum mappings, and related educational records remain the property of the school and/or student as determined by applicable law.

Eduzo does not acquire ownership rights over student educational records.

Upon termination of services, schools may request export or deletion of their data in accordance with contractual obligations and applicable law.

8. Intellectual Property

Eduzo and its licensors own all rights, title, and interest in:

  • Software
  • Games
  • Platform features
  • User interfaces
  • Graphics
  • Educational engines
  • AI systems
  • Trademarks and branding

Nothing in these Terms transfers ownership of Eduzo intellectual property to any user or institution.

Schools retain ownership of curriculum materials, worksheets, and content uploaded by the school.

9. Acceptable Use

Users shall not:

  • Reverse engineer the Platform
  • Attempt unauthorised access
  • Introduce malware or harmful code
  • Interfere with Platform operations
  • Use the Platform for unlawful purposes
  • Misrepresent their identity
  • Share account credentials without authorisation

Eduzo may suspend accounts involved in prohibited activities.

10. AI-Generated Content

Certain Platform features may generate educational content using artificial intelligence.

AI-generated content is provided as an educational assistance tool.

Schools and teachers remain responsible for reviewing educational content before classroom use.

Eduzo does not guarantee that AI-generated content will always be accurate, complete, or suitable for a specific educational objective.

11. Motion-Sensor and Computer Vision Features

Certain Eduzo experiences use motion sensing, gesture recognition, computer vision, voice interaction, or similar technologies.

These features are intended solely to facilitate educational gameplay and interaction.

Schools and teachers remain responsible for ensuring that learning environments are safe and suitable for student participation.

12. Subscription and Payment

Access to certain features may require a paid subscription.

Subscription pricing, billing cycles, and payment terms will be governed by the applicable agreement, quotation, purchase order, or invoice issued by Eduzo.

Unless otherwise agreed in writing, fees paid are non-refundable.

13. Availability of Services

Eduzo will use commercially reasonable efforts to maintain Platform availability.

However, uninterrupted access cannot be guaranteed.

Maintenance, updates, technical issues, internet disruptions, or circumstances beyond Eduzo's control may affect availability.

14. Third-Party Services

The Platform may integrate with third-party providers.

Eduzo is not responsible for third-party products, services, websites, or content.

Use of third-party services may be subject to additional terms imposed by those providers.

15. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, Eduzo disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Eduzo does not guarantee specific academic outcomes, examination results, admissions outcomes, or educational performance improvements.

16. Limitation of Liability

To the maximum extent permitted by law, Eduzo shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages.

Eduzo's total liability arising out of or relating to the Platform shall not exceed the fees paid by the relevant customer to Eduzo during the twelve months preceding the claim.

17. Indemnification

Schools agree to indemnify and hold harmless Eduzo, its directors, employees, contractors, and affiliates from claims arising out of:

  • Violation of these Terms
  • Violation of applicable law
  • Failure to obtain required permissions or consents
  • Misuse of the Platform

18. Force Majeure

Eduzo shall not be liable for delays or failures caused by events beyond its reasonable control, including natural disasters, internet failures, government actions, labour disputes, or other force majeure events.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Chennai, Tamil Nadu, India.
